5. Articles of association, if necessary in draft form
Founding of companies by foreign applicants
The residence permit for the purpose of taking up self-employment is to be requested from the responsible aliens' authority. The business concept will be checked with regard to the expected profitability on the basis of the following criteria:
- There is an economic interest or a regional need,
- It can be expected that the activity will have positive effects on the economy and
- The financing of the implementation is secured by equity capital or by an approved credit
The following documents are to be submitted to the responsible aliens authority:
1. Business plan in German
- Description of the planned business activity including the
1. Existing customer contacts in Germany/Europe
2. Number of employees and their areas of responsibility
3. Business experience of the applicant - Investment plan
- Earnings forecast
- Capital requirement plan
- Liquidity plan

2. Proof of capital
- Bank statement or credit approval of a bank
3. Curriculum vita including
- School/university certificates
- Training certificate
- professional career including working certificates / references
4. Languages (Proofs)
- German
- English
5. Articles of association, if necessary in draft form
6. Extract from Companies' Register
7. Business registration, if available
8. Managing Director's contract
9. Details about the parent company
- Business licence (translated and certified)
- Certificate of a foreign chamber of trade or comparable institutions (translated and certified)
10. On entry into an existing company or in the event of a company take-over additionally
- Extract from the companies' register
- Purchase contract and valuation of the inventories on the relevant date
- Balance sheets/Annual accounts for the last three business years
- Current business evaluations (BWA) of the tax consultant
11. Foundation of a representative office/dependent branch
- A "Letter of Appointment" (translated and certified) authorizing the applicant to open an office.
